SOLOMON FUNNA and GERTIE LEANO, INDIVIDUALLY AND ON BEHALF OF ALL OTHERS SIMILAR SITUATED v. SAGE GROUP PLC, SAGE SOFTWARE INC., UNITED STATES DISTRICT COURT, ND GEORGIA, CASE NO: 1:19-cv-01074-MLB
The Details of the Second Sage Inside Sales Rep Case
This is the second case brought against Sage Software for unpaid overtime hourse. Plaintiffs Solomon Funna and Gertie Leano worked for Sage Software in the defendant’s Atlanta and Lawrenceville offices selling software and cloud based services. The plaintiffs had production requirements and routinely worked overtime hours without being paid for all hours worked, including working through allotted meal breaks, coming in early and staying late, working from home on weekends, and other training times.
For some part of the preceding 3 years, Sage Software did not even institute a time tracking system to record the employees’ work hours. Sage also maintained a de facto policy which discouraged inside sales reps from reporting or claiming all overtime hours worked, contending that such hours had to pre-approved. Meanwhile, Sage turned a blind eye to such employees working off the clock without being paid for all hours worked.
Some inside sales reps never were paid any overtime hours due to the coercion, intimidation and other pressure to not report these hours or complain about not being paid for overtime hours under threats of heightened scrutiny and discipline and termination of employment.
If you are a present or former inside sales rep of Sage Software and were not paid a premium (overtime pay) for all hours worked, we want to speak to you about your work experience.
Damages Our Legal Complaint Seeks
Plaintiffs seek to recover overtime wages for all hours worked over 40 in each work week during the preceding 3 years and continuing. Plaintiffs also seek recovery of double the amount or sums owed as liquidated damages, plus recovery of attorney’s fees and expenses of this litigation. In addition, plaintiffs seek to require Sage Software to amend its unlawful pay practices.
