Ms. Dukes worked as an Account Executive for ERTC.COM. She has brought this nationwide FLSA collective action seeking to recover overtime wages for herself and all other inside sales reps (IRS) working as an Account Executive or Sales Development Representative during the preceding 3 years of the filing of the lawsuit to the present day.
As the complaint explains and alleges, ERTC has willfully misclassified inside sales employees as exempt from overtime wages in violation of the FLSA. The complaint alleges that inside sales employees are widely known and generally treated under the law as non-exempt employees who are legally required to be paid overtime premiums for all hours worked over 40 in each and every work week. Thus, Dukes alleges that ERTC has willfully violated the FLSA’s overtime wage requirements for employers in a scheme to avoid its overtime pay obligations.
Ms. Dukes seeks to recover overtime wages plus an equal sum in liquidated damages and attorney’s fees.
